Law and/against Reality
Theme:
Law is part of reality. It regulates behaviour, resolves disputes, and defines rights and responsibilities. Law can run ahead of reality, to devise and pro-actively implement a new society. Law can be reactive and retrospective, to stabilise developments produced by other societal dynamics. Law may be light or heavy, under- or over-regulating its subject-matter, giving wider or narrower latitude to other formants. Law may also be on-target or off-target, more or less willingly, to command or to nudge.
The apparent obviousness of the relation between the law and its subject-matter may be explored to analyse the many different ways the law grasps reality and interacts with it – sometimes to reach, sometimes to depart from the expected or desired results. But law can lag behind reality by failing to address emerging or burning issues. Either way, law mirrors and moulds reality.
Juris Diversitas calls scholars worldwide to contribute their knowledge on this topic for the Juris Diversitas 2026 International Conference in the beautiful city of Athens, one of the cradles of the world’s legal heritage, where law has been part of politics, religion, culture, art, and societal dynamics since times immemorial.
Submissions:
Panel proposals and interdisciplinary presentations are strongly encouraged, as is the participation of doctoral students and scholars from outside of the discipline of law. While parallel sessions featuring three presentations of twenty-minute each will be standard, more creative arrangements are encouraged.
Proposals should be in English or French. Proposals of circa 250 words (or 1000 words for panel proposals with three or more speakers) should be submitted to Professors Anne Tercinet (tercinet@em-lyon.com) and Gianmatteo Sabatino (gianmatteo.sabatino@unitn.it) by 12 January 2026, with a short biography paragraph listing major or relevant publications. Make this a single Word document with minimal formatting, so that proposal and biography can be copied easily into the conference program.
Registration Fees:
€200 or €125 for Juris Diversitas members who paid their 2026 dues. Special rate for young scholars under the age of thirty and scholars in developing nations: €150 or €75 for Juris Diversitas members who paid their 2026 dues. Note that fees do not cover travel, accommodation, or the conference dinner (€50).
A reduction of €25 will be applied to the fees for registration before 30 April 2026.

Le droit fait partie de la réalité. Il régit les comportements, règle les litiges et définit les droits et les responsabilités. Le droit peut anticiper la réalité, pour concevoir et mettre en œuvre proactivement une nouvelle société. L’évidence apparente de la relation entre le droit et son objet peut être déconstruite pour analyser les façons différentes dont le droit comprend la réalité et interagit avec elle – parfois pour atteindre, parfois pour s’éloigner des résultats attendus ou souhaités. Le droit peut aussi être en retard sur la réalité en ne traitant pas les problèmes émergents ou urgents. Quoi qu'il en soit, le droit reflète et façonne la réalité.
Juris Diversitas appelle les chercheurs et amis du monde entier à apporter leurs connaissances sur ce sujet pour la Conférence internationale Juris Diversitas 2026 dans la belle ville d’Athènes, l’un des berceaux du patrimoine juridique mondial, où depuis des temps immémoriaux le droit fait partie de la politique, de la religion, de la culture, de l’art et de la dynamique sociétale générale.

Over 30 papers will be presented and discussed by leading experts on the Louisiana Civil Code, along with national and international scholars. The conference will illustrate how Louisiana, as the first jurisdiction in the world to codify its private law following the Napoleonic Code, developed a code that is not merely a replica of the French Civil Code. The relevance and content of the 1825 Civil Code, as well as its influence in the United States, the Americas, and other parts of the world, will also be explored. Additionally, the future of codification in mixed jurisdictions and the global context will be debated.
The papers presented will be of interest to the broader legal community and provide opportunities to earn Continuing Legal Education (CLE) credits. The conference will also appeal to those interested in local and world history, law, languages, and social sciences.
The conference will feature the 44th Tucker Lecture in Civil Law as its keynote address on the evening of the first day. This lecture will be delivered by Professor Agustín Parise, who holds two law doctorates from the Universities of Buenos Aires (Argentina) and Maastricht (The Netherlands), where he serves as a law professor.
Presentations will primarily be in English, with some in French, as laws at the time were published in both languages. The Consul General of France in New Orleans will open the event, coinciding with the Journée internationale de la francophonie on March 20.
While the Tucker Lecture is open to the public, conference attendance requires prior registration, which is free for LSU faculty and students. The program and registration forms are available on the CCLS website.

The Theme:
‘Convivencia’: Com-paring Legal Scenarios of a Life Together in Harmony
In a seemingly dystopian present or era of post-truth, can the various dichotomous conceptions of law based on dualistic reasoning still be maintained? Or, are we no longer able to maintain the narrative of a normative universe by constantly creating and maintaining ‘a world of right and wrong, of lawful and unlawful, of valid and void’, as Robert M. Cover wrote?
In view of the apparent contradictions caused by a growing number of complex cross-cutting, cross-boundary and cross-cultural phenomena, such as artificial intelligence, climate change or zoonotic diseases, the time may have come again to rethink and transcend the dualisms that guided human thinking for a long time, creating wide gaps between not only law and law, but also between law and other scientific areas.
Juris Diversitas invites abstracts for papers that seek to not only identify different legal problems by contrasting their underlying causes but also by ‘com-paring’ them in the spirit of ‘convivencia or living together in harmony and in a way respectful of difference’. Convivencia is a term the late comparatist H. Patrick Glenn applied to explain ‘com-paring’ by describing it as ‘an enduring process of peaceful co-existence (in spite of difference in spite of potential conflict), in a way which ensures not uniformity but ongoing diversity’. While this call for papers is as open as it can be in a spirit of convivencia, we welcome proposals that apply a new legal logic aiming to break free from the ironclad shackles limiting the imaginative and creative power of the legal mind.

Dans un présent apparemment dystopique ou une ère de post-vérité, les diverses conceptions dichotomiques du droit fondées sur un raisonnement dualiste peuvent-elles encore être maintenues ? Ne sommes-nous plus capables de maintenir le récit d’un univers normatif en créant et en entretenant « un monde de bien et de mal, de licite et d’illicite, de valide et de nul », comme l’écrivait Robert M. Cover ?
Face aux contradictions apparentes causées par un nombre croissant de phénomènes transversaux, transfrontaliers et transculturels complexes, tels que l’intelligence artificielle, le changement climatique ou les maladies zoonotiques, le moment est peut-être venu de repenser et de transcender les dualismes qui ont longtemps guidé la pensée humaine, créant de grands écarts non seulement entre le droit et le droit, mais aussi entre le droit et les autres domaines scientifiques.
Juris Diversitas fait appel à des contributions qui cherchent non seulement à identifier différents problèmes juridiques en contrastant leurs causes sous-jacentes, mais également en les « comparant » dans l’esprit de « convivencia ou vivre ensemble en harmonie et dans le respect de la différence ». Convivencia est un terme que le regretté comparatiste H. Patrick Glenn a utilisé pour expliquer la « comparaison » en la décrivant comme « un processus durable de coexistence pacifique (en dépit des différences et des conflits potentiels), d'une manière qui garantit non pas l’uniformité mais une diversité dynamique ». Si cet appel à communications se veut aussi ouvert que possible dans un esprit de convivialité, nous valorisons les propositions qui appliquent une nouvelle logique juridique visant à se libérer des chaînes qui limitent le pouvoir imaginatif et créatif de l’esprit juridique.

The American University Law Review has issued a Call For Papers for its annual symposium. Here is the call.The American University Law Review is placing a call for submissions of original legal articles and scholarly commentaries for its forthcoming issue dedicated to pop culture and the law. Specifically, the Law Review seeks submissions analyzing the sports, media and entertainment, fashion, and social media industries and their effect on the law. However, other topics related to pop culture will be considered. The target publication date is slated for mid-2025.
Next year, the Law Review’s Spring Symposium will be held on February 7, 2025. This symposium will explore and engage with burgeoning legal issues in pop culture. Selected authors may have the opportunity to present their work as a panelist in the Symposium, but participation is not a requirement for consideration.
Legal imaginaries across the Asia-Pacific: Vernacular laws and literatures

]]>This event represents the first fruits of a new network that targets a specific geographic constellation and identifies, through the language of ‘the imaginary’ and ‘vernacular’, a specific set of theoretical resources. ‘Laws and literatures’ both frames the endeavour in relation to the rich field of studies in law and literature, and pluralises it in significant ways. Collaborative partners in the broader project include University of Wollongong, Hong Kong University, National University of Singapore, and University of British Columbia.
This one-day workshop would be of interest to academics and HDR students in literature, law and the humanities, legal theory, and postcolonial studies. It features new work from prominent and emerging scholars working in law and literature from right across the region -- from Australia, Aotearoa, the Pacific and Mexico to Hong Kong, Singapore, and Indonesia – showcasing new directions with what we might call a common indicazione geografica tipica, and indicazione teorica tipica.

]]>Scholars in recent years have shown interest in challenging the historical origins of international law and its normative claims to universality. This Article challenges the prevailing conceptions of Islamic international law (al-siyar), first set out in English-language scholarship by Majid Khadduri, as primarily an ad-hoc response to the failed aspiration of a universal Muslim commonwealth. It shows that Islamic international law, in its classical phase (eighth–thirteenth centuries), as first formulated by Iraqi, and later, Central Asian, scholars (who together later came to be known as Ḥanafīs), understood all legal order as being rooted in sovereignty and territoriality, with shared religion a secondary concern. This theory of legal order arose out of an understanding of political order as emerging from a natural and universal condition of war that is incidental to the individual’s natural sovereignty. I trace the genealogy of this conception to the founding moment of the Muslim commonwealth and describe its manifestation in classical Ḥanafī solutions to a series of cases in “private international law.”

In many societies, legal frameworks and cultural norms have historically marginalized certain groups, rendering them invisible and their voices unheard. This volume seeks to challenge these entrenched structures by providing a platform for critical analyses and innovative solutions. We are particularly interested in contributions that not only highlight the problems but also propose transformative pathways towards greater visibility, recognition, and justice.
The volume will explore various dimensions of gendered silencing and invisibility, including historical perspectives, intersectional identities, personal narratives, and the role of activism. By examining these issues through a global lens, the volume aims to provide a comprehensive understanding of how different cultures and societies deal with the challenges of gender justice.
Contributors are encouraged to use a variety of theoretical frameworks and methodological approaches to address the following key questions:
- How do legal and cultural systems perpetuate the silencing and invisibility of certain gendered bodies and voices?
- What are the historical roots of these practices, and how have they evolved over time?
- How do intersectional identities impact experiences of visibility and voice?

Reimagining Legal Pluralism in Africa
Balancing Indigenous, State, and Religious Laws

This collection challenges the prevailing conflict of laws approach to the
interaction of state and indigenous legal systems. It introduces adaptive
legal pluralism as an alternative framework that emphasises dialogue
and engagement between these legal systems. By exploring a dialogic
approach to legal pluralism, the authors shed light on how it can
effectively address the challenges stemming from the colonial
imposition of industrial legal systems on Africa’s agrarian political
economies.
Biographical Note
Anthony C. Diala, Ph.D. (2016), is a distinguished Professor of African law
and Director of the Centre for Legal Integration in Africa at the
University of the Western Cape, South Africa. Renowned for his research,
he specialises in legal pluralism, comparative law, and human rights in
Africa.
Christa Rautenbach, LL.D. (2001), is a distinguished Professor of Law at

]]>Baton Rouge, April 22, 2024. A delegation of four distinguished French law professors presented at an afternoon conference on how French tort law faces environmental challenges, to an audience including law professors from LSU, Southern University, Loyola University College of Law and Mississippi College.
Mustapha Mekki, Professor at the Sorbonne Law School, Université Paris 1 Panthéon Sorbonne, General Director of INFN, presented on Litigating Climate Liability: An Example of Democracy in Litigation, followed by Nathalie Blanc, Professor at the Sorbonne Paris Nord University, co-Director of IRDA, discussing Corporate Social Responsibility. Philippe Pierre, Professor at the University of Rennes, Holder of the International Chair of Notarial Law, then discussed The Notary’s Liability and Duty to Advise on Environmental Matters. Finally, Bernard Haftel, Professor at the Sorbonne Paris Nord University, co-director of IRDA, presented on The Compensation of Environmental Damage.
Each paper was discussed and a lively general discussion closed the event, followed by a tour of the LSU Campus. The conference papers will be published in the Journal of Civil Law Studies.
This article addresses the significant research gap concerning the regulation of surrogacy intermediaries in China’s rapidly growing surrogacy market. Employing a ‘law in context’ perspective, it explores the question of how to effectively regulate surrogacy intermediaries in the Chinese context. Situated within China’s unique socio-cultural landscape, where procreation carries profound significance, the study navigates the complexities of surrogacy regulation, including ethical dilemmas, rights infringements and regulatory ambiguities. The article advocates for the regulation of surrogacy in China to prevent possible exploitation, referencing three international models: prohibiting commercial surrogacy, governing non-profit surrogacy organisations and imposing duties on for-profit surrogacy agents. The aim is to construct a robust, context-sensitive regulatory framework for surrogacy in China, focusing on identifying suitable intermediaries and defining the scope of effective regulatory oversight.

Our Special Issue delves into the intricate and dynamic nature of legal systems, contrasting concepts of linear progression with those of the perpetual pendulum in law. This exploration integrates the rhizomatic theory of Gilles Deleuze and Félix Guattari, proposed in 1987, which suggests a non-linear, network-like framework for understanding legal changes. It challenges conventional views of law as a hierarchy, instead presenting it as a complex web of interconnections where various factors, including political, cultural, economic, and social energies, interact in unpredictable ways. This approach acknowledges the multifaceted nature of legal evolution, encompassing both steady, predictable developments and cyclical, reactionary shifts.
This exploration extends to consider the non-hierarchical, network-like nature of legal evolution. This theory challenges traditional, tree-like conceptions of knowledge and organization by proposing a model where any point can connect to any other, without having a central or primary node. Applying this to legal evolution offers a more complex and interconnected view of how law changes and adapts, recognizing the multiplicity of influences and pathways of development.
Topics for Submission:
1. Rhizomatic Perspectives in Legal Evolution: Exploration of Deleuze and Guattari’s rhizome theory in the context of legal systems, examining how law evolves in a non-linear, network-like fashion, creating multiple entry and exit points for legal changes and influences.
2. Law-Making in a Networked Society: Analyzing how the concept of the rhizome influences the development of law-making tools and their societal impacts, emphasizing the interconnected and often unpredictable nature of legal evolution.
3. Interplay of Linear and Rhizomatic Legal Interpretations: Investigating the balance between linear progression and rhizomatic complexity in legal interpretation, focusing on how these approaches impact the adaptability and responsiveness of legal systems to societal changes.
4. Polarization and Connectivity in Legal Concepts: Analyzing the dual nature of law as both polarized (perpetual pendulum) and interconnected (rhizomatic), exploring how these contrasting dynamics influence legal theory and practice.
5. Legal Systems Amidst Global Crises: Discussing the rhizomatic responses of legal systems to global crises, such as pandemics or climate change, and how these events disrupt linear progressions, necessitating a more networked, adaptable approach to legal reform.
These themes aim to enrich our understanding of legal evolution by highlighting the interplay between linear and cyclical dynamics, and introducing the complexity and interconnectedness of the rhizomatic approach. This perspective acknowledges the multi-dimensional nature of legal change, influenced by a myriad of societal, cultural, and technological factors.
Submission Guidelines:
Contributors are invited to delve into the multifaceted dynamics of legal evolution as framed in “Rhizomatic Law: Understanding the Linearity and Pendulum of Legal Evolution”. Submissions should focus on the intricate interplay of factors influencing the oscillation between linear progression and the cyclical shifts of the perpetual pendulum in legal systems. We welcome theoretical and empirical contributions that shed light on these dynamics. Interdisciplinary approaches, integrating insights from legal studies, philosophy, sociology, and other relevant fields, are especially encouraged. This call for papers aims to create a
comprehensive platform for discussing and understanding the complex, network-like nature of legal change and adaptation, guided by the rhizomatic perspective.

The Journal for Digital Legal History (DLH) is a diamond Open-Access, peer-reviewed international journal hosted by the Open UGent platform. For our second issue, which will be published in November 2024, we are pleased to invite contributions from researchers working on legal history with digital, empirical and computational approaches. The journal welcomes all research questions and outputs at the intersection of legal history, digital humanities and empirical legal studies, broadly defined.
In the field of legal history, digital methods are hardly ever the centrepiece of a publication itself, if not downplayed. In 1997, Richard Evans claimed that: 'How we know about the past, what historical causation is, how we define a historical fact, whether there is such a thing as historical truth or objectivity - these are questions that most historians have happily left to one side as unnecessary distractions from their essential work in the archives' (R. Evans, In Defence of History, 1997, p. 9). Nevertheless, in the 21st century, the work of a historian or legal scholar does not stop in the archives. Often, digital or computational techniques are applied in seemingly pedestrian ways, such as "searching" full texts, or they are applied in more elaborate methods to transform the historical facts embedded in our precious archival material or legal documents to answer novel research questions or to explore well-trodden paths from an innovative perspective.
The application of digital techniques to legal history research is often overlooked or omitted from discussions on methodology. We encourage you to highlight the technical tools or methods that proved effective in your research projects without neglecting all the trials and errors that helped structure your final choice of any particular technique. You are welcome to illustrate your work with all forms of outputs, from notebooks to graphs, networks, maps, diagrams, etc.. If you have developed software, a database or a dataset that others could reuse, feel welcome to publish it with us.

Submissions that address legal sources from any historical period and any part of the world are welcome. We actively encourage collaborative and multi-authored pieces by authors from different countries working across disciplines.

]]>Human rights are avowedly universal but must be translated by local activists to make sense in specific contexts, a process Sally Engle Merry called vernacularization. Human rights progress is conventionally measured through global quantitative indicators which give the illusion of control and comparability, but radically oversimplify social and political processes. How can we avoid “the seductions of quantification” and understand how human rights are materialized, appropriated, and implemented in everyday social justice activism? In her decades-long research on human rights, Sally Engle Merry brought to light the complex social dynamics in which human rights are embedded and demonstrated how their presentation as single, universal, and immutable elides their flexibility and many strengths.
To celebrate a new book in her honour, The Complexity of Human Rights: From Vernacularization to Quantification, leading human rights scholars come together to discuss how the concepts Merry pioneered help us to understand current human rights challenges and crises.

8th Global Conference Call for Papers
The Younger Comparativists Committee (YCC) of the American Society of Comparative Law (ASCL) is pleased to invite submissions for its Eighth Annual Conference, to be held on May 10-11, 2019, at McGill University Faculty of Law in Montreal, Québec. The purpose of the conference is to highlight, develop, and promote the scholarship of younger scholars of Comparative Law. Planning for the Conference is undertaken by the YCC Program Committee in consultation with the Annual Program Committee of the ASCL.
Conference Subject-Matter and Eligibility
Submissions will be accepted on any subject in public or private comparative law. By “younger,” we mean graduate students, law teachers, lecturers, fellows, or others, provided that they have not held a full-time academic position since before July 1, 2009 (i.e., less than 10 years as of June 30, 2019). Submissions from full-time faculty, research fellows, and graduate students are equally welcome.
Submission Instructions
To submit an entry, scholars should email an attachment in Microsoft Word or PDF containing an abstract of between 500 and 750 words to ycc.conference.2019@gmail.com. The deadline for submission is January 31st, 2019. Abstracts received thereafter will not be considered.
Abstracts should reflect original research that will not yet have been published, but may have been accepted for publication, by May 1, 2019. Interested participants should include the author’s name, title of the paper, institutional affiliation, contact information, and three to five keywords. In the email, the author should certify that she/he qualifies as a younger scholar. Graduate students should identify themselves as such in the email. Proposals for fully formed panels are encouraged. Panels must center around a common theme and include a confirmed list of panel members, abstracts for each presenter, and other required information. Please include the words “Panel Proposal” in the subject line of your email. If you are submitting a panel you are also welcome to invite a Senior Scholar from the McGill Faculty as discussant for your panel. Each scholar may make only one submission. Both individual and co-authored submissions will be accepted. For co-authored submissions, both authors must qualify as younger comparativists. The conference’s Program Committee will assign individual and co-authored submissions to thematic panels according to subject area. Notification Authors of the submissions selected for the conference will be notified no later than February 15, 2019. There is no cost to register for the conference but participants are responsible for securing their own funding for travel, lodging and other incidental expenses. A limited number of travel stipends, of up to $400, may be awarded to those who indicate financial need. Priority will be given to faculty and students of ASCL Member Institutions.[Rk1] . Phanor J. Eder Prize in Comparative Law
The YCC in consultation with the Prizes Committee of the American Society of Comparative Law will award the Phanor J. Eder Prize for the best paper submitted by a J.D., B.A., or LL.B. or other student who has not yet completed the first law degree as of April 1, 2019. The author(s) of the winning paper will receive a modest stipend to help defray the costs of attending the Conference and presenting the paper there. A separate call will be forthcoming with the details of the Phanor J. Eder competition. Final papers will be due on February 28, 2019, in order to be considered for the competition. The School of Law at NUI Galway, Ireland will host the Irish Society of Comparative Law (ISCL) 5th Annual Conference on Friday 24th and Saturday 25th
of May 2013 in Galway. The theme for the ISCL Conference is ‘Comparative Public Law’. Papers
